On February 28, 2023, our Partner, Ms Amrita Chatterjee and Associate, Mr Happy Malhotra, appeared on behalf of the Petitioner before the Hon’ble High Court of Delhi and were successful in attaining the order for quashing of the F.I.R filed against the Petitioner. The case pertained to a matrimonial dispute where the parties had reached a monetary settlement and had signed an MoU.
Pursuant to the settlement, the parties to the matrimonial dispute had also obtained a decree for divorce and were residing in separate accommodations. While the Respondent No. 2 alleged a misrepresentation of facts at the signing of the MoU, the Hon’ble Court held that there was no action taken in lieu of such claim, and thus the settlement agreement was valid under law.
After due deliberations and detailed arguments, the Hon’ble Court was pleased to pass a favorable order, which released our client from any criminal liability arising from the FIR in question. The order can be accessed here:
